The second section introduces the concept of “chilling effect” used in decisions about freedom of speech, analyzes the constitutional protection of commercial speech as a manifestation of the freedom of speech, and describes the test developed in the United States and Spain to analyze restrictions to commercial speech. The third section applies the test to the regulation of comparative advertising in Peru and concludes that this regulation is unconstitutional.Este artículo contiene una crítica a la regulación de la publicidad comparativa en el Perú. En la primera sección del artículo se describe la evolución del tratamiento regulatorio de la publicidad comparativa en el Perú y explica el “efecto intimidatorio” causado por su regulación actual. En la segunda sección se introduce el concepto de efecto intimidatorio empleado en la jurisprudencia sobre libertad de expresión, se hace un análisis de la publicidad comercial como objeto de protección constitucional al ser manifestación de la libertad de expresión y se describe el test empleado en Estados Unidos y España para el análisis de las restricciones de la libertad de expresión comercial.
