It is necessary to evaluate the effect of documented informed consent on the legitimacy of the medical act. The methodology will be the case study and documentary content analysis, obtaining as a result that this is a component of legitimacy of the medical practice, and a constitutional, legal and ethical obligation of the physician in front of the patient's rights.En la responsabilidad penal médica son importantes los elementos del Art. 146 del Código Orgánico Integral Penal, en su figura simple como agravada, que sanciona un acto médico realizado sin el Consentimiento Informado del paciente. En correspondencia ¿Es el Consentimiento Informado documentado el elemento esencial de la legitimidad del acto médico en el Ecuador? Es necesario evaluar el efecto del Consentimiento Informado documentado sobre la legitimidad del acto médico.
