Summary: In medical criminal liability, the elements of Art. 146 of the Organic Integral Penal Code are important, both in its simple and aggravated form, which punishes a medical act performed without the patient's Informed Consent. Correspondingly, is the documented informed consent the essential element of the legitimacy of the medical act in Ecuador? It is necessary to evaluate the effect of documented informed consent on the legitimacy of the medical act. The methodology will be the case study and documentary content analysis, obtaining as a result that this is a component of legitimacy of the medical practice, and a constitutional, legal and ethical obligation of the physician in front of the patient's rights.
