Second, we discuss patterns of arguments that are used by courts to decide politically controversial issues as well as political and institutional factors that stimulate the occurrence of “activists” positions.Neste artigo discuto as relações conflitantes entre o “ativismo judicial” e os procedimentos democráticos representativos. Primeiramente eu discuto algumas definições que realçam os aspectos “normativos/prescritivos” das posturas judiciais “ativistas” e do funcionamento das instituições democráticas “realmente existentes”.
