Summary: The extraordinary expansion of the entrepreneur’s capacity to investigate as a result of the generalization of ICT, social media and, in general, Internet 2.0, has once again raised the traditional problem of the field on which the employer can develop control in the unique case of trending companies. This work takes up old studies to, after delimiting this basically doctrinal concept, within the framework now offered by EU law, to analyse the impact on the modulation of fundamental rights in recent years by both the ECHR, ECJ and Spanish TC. In this context, the ideological qualification of the benefit is resumed from a gradualist and non-binary logic, as the best formula for framing in the contractual dynamics these singularities, articulating the duties outside time and place of work within the framework obligations arising from good faith and preparatory diligence, with the consequent effect on the delimitation of the supervisory and sanctioning power of the employer. The work concludes with a few brief lines on the impact in this area of the progressive assumption for an increasing number of companies in a series of “values”, specifically analyzing the admissibility and limits of certain protocols.
