This study revisits the debate about the relationship between law and ideology by legal theory in Brazil in the 1980s and 1990s and suggests some elements for its updating. Then, it analyses three concrete situations of intervention by the Federal Public Ministry in the field of public education. The limits of manifestations considered ideological by educators and members of the academic community or simply in the space of institutions are discussed, based upon constitutional principles. We hope to demonstrate the importance of taking a critical perspective on the analysis of ideologies and their effects on the theory and practice of law. |
