As an education is a foreseen right in the Federal Constitution of 1988 and, considering a democratic scenario and coexistence with human plurality, it is essencial the full realization of inclusive education and specialized educational assistance for people with disabilities. The research was developed according to the hypothetical-deductive method and the methodology used is the bibliographic. It appears that there is a state omission or insufficient protection to implement public policies that substantiate this guarantee for individuals with disabilities, which hurts the dignity of the human person and generates the absence of adequate structure in schools.O artigo explora as questões relativas ao direito à educação escolar para a pessoa com deficiência. Tem por objetivo identificar os óbices atinentes à materialização desse direito fundamental e analisar os instrumentos normativos que a sociedade pode utilizar para pleitear a concretização dessa garantia. Sendo a educação um direito previsto na Constituição Federal de 1988 e, considerando um cenário democrático e de convivência com a pluralidade humana, é imprescindível a plena efetivação da educação inclusiva e do atendimento educacional especializado para as pessoas com deficiência. A pesquisa desenvolveu-se segundo o método hipotético-dedutivo e a metodologia utilizada é a bibliográfica.
