Laburpena: This study explores issues related to the right to school education for a person with disability. It aims to identify the obstacles related to the materialization of this fundamental right and to analyze the normative instruments that society can use to request the realization of this guarantee. As an education is a foreseen right in the Federal Constitution of 1988 and, considering a democratic scenario and coexistence with human plurality, it is essencial the full realization of inclusive education and specialized educational assistance for people with disabilities. The research was developed according to the hypothetical-deductive method and the methodology used is the bibliographic. It appears that there is a state omission or insufficient protection to implement public policies that substantiate this guarantee for individuals with disabilities, which hurts the dignity of the human person and generates the absence of adequate structure in schools.
