Second, establishing additional guarantees for special categories of data and the treatment of sensitive data of workers that reinforce the fundamental right not to be discriminated. To achieve these goals it would be opportune that collective agreements incorporate specific Protocols to provide greater security and protection to the fundamental rights.La aprobación de la nueva normativa comunitaria y española de protección de datos personales y garantía de los derechos digitales posibilita que la negociación colectiva desempeñe un papel más incisivo en la regulación de todas las cuestiones relacionadas con el tratamiento de los datos personales de los trabajadores principalmente de dos maneras. Por un lado, estableciendo normas específicas adecuadas a cada realidad empresarial para concretar el contenido del derecho de desconexión digital y el ejercicio de las facultades de control empresarial respecto de los derechos digitales y, por otro, fijando garantías adicionales para las categorías especiales de datos y el tratamiento de los datos sensibles de los trabajadores que refuercen el derecho fundamental a no ser discriminado del artículo 14 CE.
