The paper seeks to show how this classical historical narrative combines, in a teleological key, what Robert Gordon has called “static” and “dynamic” modes of using the past, being both authoritative modes of using of the past. We try to show how, in this context, the image of the Ancient Regime’s criminal justice, works as a “dormant tradition” (taking this concept from Rüsen). Finally, we try to explore the possibilities of a critical use of history in teaching criminal lawEste artículo procura analizar el rol de la narrativa histórica en la enseñanza del derecho penal en el nivel universitario en Argentina, focalizándose en la brecha entre la más reciente investigación historiográfica y la narrativa histórica clásica utilizada como introducción por los tratados y manuales orientados a la enseñanza del derecho penal. El trabajo busca mostrar cómo esta narrativa histórica clásica combina, en clave teleológica, lo que Robert Gordon ha llamado modos “estático” y “dinámico” de usar el pasado, siendo ambos modos autoritativos de usar el pasado. En ese contexto, procuramos mostrar, cómo la imagen de la justicia criminal del Antiguo Régimen funciona como “tradición latente” (tomando este concepto de Rüsen).
