Summary: This paper attempts to analyze the role of historical narrative in teaching criminal law at the university level in Argentina, focusing on the gap between the most recent historical research and the classical historical narrative used as introduction by treaties and manuals aimed at teaching criminal law. The paper seeks to show how this classical historical narrative combines, in a teleological key, what Robert Gordon has called “static” and “dynamic” modes of using the past, being both authoritative modes of using of the past. We try to show how, in this context, the image of the Ancient Regime’s criminal justice, works as a “dormant tradition” (taking this concept from Rüsen). Finally, we try to explore the possibilities of a critical use of history in teaching criminal law
