This paper analyzes the implications of applying the constitutional principle of legality to private law. Article 5, II of the Constitution of the Republic states that "no one shall be compelled to do or to do anything other than by virtue of law." Through this principle, the Constitution enshrines the notion of freedom, which also reveals itself through the principles of private autonomy and free enterprise, the latter embodied in its articles 1, IV and 170, sole paragraph. Both private autonomy and free enterprise are reflected in freedom of association (Article 5, XVII CR) and in non-interference by the state (Article 5, XVIII). The subject of international contracts will be analyzed from the standpoint of Constitutional Civil Law, to support the predominance of the principle of private autonomy as one of the bases of the Brazilian legal system, erected to the category of fundamental precept of the Brazilian constitutional order. The principle of private autonomy and the principle of public autonomy (freedom of community life) are the foundations of life in freedom and of the dignity of the human person, integrating the role of fundamental rights and building the foundations of democracy, and are therefore unaffordable.

O artigo 5º, II da Constituição da República diz que “ninguém será obrigado a fazer ou deixar de fazer alguma coisa senão em virtude de lei”. Através deste princípio, a Constituição consagra a noção de liberdade, que também revela-se através dos princípios da autonomia privada e da livre iniciativa, este último consubstanciado em seus artigos 1º, IV e 170, § único. Tanto a autonomia privada quanto a livre iniciativa se refletem na liberdade de associação (artigo 5º, XVII CR) e na não-interferência estatal (artigo 5º, XVIII). O tema dos contratos internacionais será analisado sob a ótica do Direito Civil Constitucional, para sustentar a predominância do princípio da autonomia privada como uma das bases do ordenamento jurídico brasileiro, erigido à categoria de preceito fundamental da ordem constitucional brasileira.
