Summary: The study examines some of affirmative actions in the course of the history of Brazil in the native indians educational system as a mechanism for implementation of the Fundamental Right to Education. It discusses historical elements of the native indians educational system and the positive legislation, giving fundamental nature of the right to education. Thus, when naming the right to education as a Fundamental Right, the article indicates the role of public managers in adopting policies outlined for its effectiveness. The methodological approach used is the analytical and interpretative research and the analysis of legislation, particularly to Educational Law.
