However, in the absence of a legal provision that regulates this issue, there is a signifcant uncertainty. Given the practical relevance of the topic, a legal reform that includes a clear and specifc regulation of the competence of the Courts is advisable.El cambio de criterio de la Corte de Apelación sobre su competencia para resolver recursos contra resoluciones emitidas por el director de onapi ha generado una relevante controversia en los últimos meses. Tanto la postura tradicional de interpretación literal de la Ley 20-00, como las que ha sostenido la jurisprudencia a raíz de la reciente reforma constitucional de 2010 pueden ser válidas y justificadas bajo el marco legal vigente. No obstante, al no haber legislación clara al respecto y estar sujetos a interpretaciones jurisprudenciales, nos encontramos ante una gran incertidumbre jurídica sobre los tribunales competentes.
