Summary: The recent changes in the case law of the Court of Appeals on its jurisdiction to decide appeals against resolutions issued by the Director of the Dominican Patent Trade Offce (pto) have been quite controversial. All interpretations, including the literal understanding of Law 20-00, may be valid and justifed under the current legal framework. However, in the absence of a legal provision that regulates this issue, there is a signifcant uncertainty. Given the practical relevance of the topic, a legal reform that includes a clear and specifc regulation of the competence of the Courts is advisable.
