Summary: This paper intends to resume the discussion of the judicial review as guarantor of the procedural conditions for the exercise of public autonomy. To achieve this goal it is necessary that the Supreme Court takes seriously the legislative process as an institutionalized space of autonomy of every citizen. Thus, the article analyzes recent concrete cases in which, in times of crisis, the Supreme Court failed to act as the guarantor of due legislative process.Keywords: judicial review, legislative process, Supreme Court.
