The present article intends to emphasize the paradigmatic framewoks of the Democratic State of Law, especially
regarding the relations between the Solidarity Principle, social rights effectiveness and democracy development in
Brazil, a country which, despite its economical world status, suffers from dramatic social exclusion. Consequently, as
well as because of lacking popular representativeness and Constitutional commitment from the Legislative and the
Executive Powers, the Judicial Power´s performance draws attention to its public policies realization, which lead to
Constitutional and International Treaty based human rights concretization and, therefore, disrupts juridic positivism
inherent abstract discussions. |
