The Civil Code, to define the action of a paternity dispute is very personal, do not link the line of succession, guaranteeing the redemption of its origins and history. Moreover, the Constitutionalisation of Civil and reflection on the scope of Legal Positivism require new reading of the Civil Code, shaping it to the constitutional principles.O reconhecimento judicial da relação familiar avoenga é respaldado pelo Constitucional Princípio da Dignidade da Pessoa Humana, que abrange os direitos de personalidade, dentre os quais o nome e sobrenome, expressões da Identidade Pessoal Familiar e deve prevalecer sobre outras normas ou princípios por se tratar de cláusula geral e fundamento do Estado Brasileiro. O Código Civil, ao definir que a ação de investigação de paternidade é personalíssima, não vincula a linha sucessória, garantindo-lhe o resgate de suas origens e história.
