This paper is an analysis of Spanish positive law, in particular, focuses on
the analysis of the regulatory framework established by LRMA, for further consideration
of the main determinants of technical and legal aspects of the current regime on
environmental liability companies. It is especially considered the treatment of strict
liability with respect to the development of a business or professional capacity to
generate environmental impacts and, therefore, assess the environmental risks. |
