Given the legislative omission, the recent decision of the Supreme Court recognizes that the stable homosexual union, goes to meet this new paradigm. Using care to protect this vulnerable group, our Constitutional Court break this �taboos� and respects the core principles of our highest law, demonstrating that the freedom to free sexual orientation is part of human dignity.O conceito de família não pode ficar atrelado apenas ao �casamento, sexo e reprodução�. A família moderna deve ter um conceito muito mais amplo, razão pela qual necessita ser reconhecido, sem preconceito e discriminação, que afetividade e felicidade é que devem ser elementares para sua definição. Diante da omissão legislativa, o recente julgado do Supremo Tribunal Federal que reconhece a união estável homossexual vai ao encontro desse novo paradigma. Utilizando o cuidado para proteção desse grupo vulnerável, nossa Corte Constitucional quebra �tabus� e respeita princípios nucleares de nossa Lei Maior, demonstrando que a liberdade à livre orientação sexual faz parte da dignidade humana.El concepto de familia no puede estar vinculada sólo a �el matrimonio, el sexo y la reproducción.� El concepto de familia moderna debe comprenderse en uno más amplio, que se debe reconocer sin prejuicios ni discriminación; el afecto y la felicidad son básicos para su definición. Habida cuenta de la omisión legislativa, la reciente decisión de la Corte Suprema reconoce que la unión homosexual estable va al encuentro de este nuevo paradigma.
