The implementation of the Accusatory Criminal Justice System in Mexico began with the Constitutional Reform of 2008. This legislative transformation set the foundations for the change of the inquisitorial criminal model to an accusatorial criminal model. A term of eight years was established to its general and particular completion in Mexico and its federative entities. Five years after this deadline and with the unprecedented international contingency caused by the COVID-19 pandemic, the inefficiency and adversities of the current adversarial have become evident. For this reason, this article exposes an analysis of the current panorama of the New Accusatory Criminal System in Mexico, as well as a comparative study describing the situation in some Latin American countries, especifically Chile and Colombia, in terms of criminal law and its interrelation with human rights.

Essa transformação legislativa estabeleceu as bases para a mudança do modelo penal inquisitorial para um modelo penal acusatório. Foi estabelecido um prazo de oito anos para que sua implementação no México e em seus estados seja realizada de forma geral e particular. Cinco anos após esse prazo e com a contingência internacional sem precedentes devido à pandemia do COVID-19, ficaram evidentes a ineficiência e as adversidades do atual sistema acusatório. É por isso que neste artigo é apresentada uma análise do panorama atual do Novo Sistema Acusatório Penal no México, bem como um estudo comparativo, descrevendo a situação em alguns países da América Latina, especificamente Chile e Colômbia, em termos de direito penal e sua intersecção com os direitos humanos.La instrumentación del Sistema de Justicia Penal Acusatorio en México inició con la Reforma Constitucional en 2008. Esta transformación legislativa estableció los cimientos del cambio del modelo penal inquisitivo a un modelo penal acusatorio. Se estableció un período de ocho años para que se cumpliera de manera general y particular su implementación en México y en sus entidades federativas.
