Summary: The implementation of the Accusatory Criminal Justice System in Mexico began with the Constitutional Reform of 2008. This legislative transformation set the foundations for the change of the inquisitorial criminal model to an accusatorial criminal model. A term of eight years was established to its general and particular completion in Mexico and its federative entities. Five years after this deadline and with the unprecedented international contingency caused by the COVID-19 pandemic, the inefficiency and adversities of the current adversarial have become evident. For this reason, this article exposes an analysis of the current panorama of the New Accusatory Criminal System in Mexico, as well as a comparative study describing the situation in some Latin American countries, especifically Chile and Colombia, in terms of criminal law and its interrelation with human rights.
