This article describes a legal analysis of the international standard on the right to justice with a view to its execution by the Colombian State, through the expedition of the Legal Framework for Peace. The judicial mechanisms of transitional justice established to guarantee, to the maximum extent possible, “the rights of victims to truth, justice and reparation” (A.L. 01/012, art. 1) are examined. Principally, it seeks to answer this question: how to guarantee the implementation of the international duty to investigate and to punish serious human rights violations and grave international humanitarian law infringements by means of the judicial mechanisms of transitional justice set in the Legislative Act 01 of 2012?

São examinados os mecanismos judiciais de justiça de transição estabelecidos para garantir o melhor possível "os direitos das vítimas à verdade, justiça e reparação" (A.L. 01/2012, art. 1). Acima de tudo, busca responder à questão de: como garantir a implementação do dever internacional de investigação e punição de graves violações de direitos humanos e graves infrações do direito internacional humanitário por meio dos mecanismos judiciais de justiça de transição estabelecidos no Ato Legislativo 01 de 2012?En este artículo se realiza un análisis jurídico del estándar internacional sobre el derecho a la justicia con miras a su implementación por parte del Estado colombiano mediante la expedición del Marco Jurídico para la Paz. Se examinan los mecanismos judiciales de justicia transicional establecidos para garantizar en la mejor medida posible “los derechos de las víctimas a la verdad, la justicia y la reparación” (A.L. 01/2012, art. 1).
