Summary: This article describes a legal analysis of the international standard on the right to justice with a view to its execution by the Colombian State, through the expedition of the Legal Framework for Peace. The judicial mechanisms of transitional justice established to guarantee, to the maximum extent possible, “the rights of victims to truth, justice and reparation” (A.L. 01/012, art. 1) are examined. Principally, it seeks to answer this question: how to guarantee the implementation of the international duty to investigate and to punish serious human rights violations and grave international humanitarian law infringements by means of the judicial mechanisms of transitional justice set in the Legislative Act 01 of 2012?
