In this environment of generalized automation, Smart Contracts that can be made between the parties and that have the capacity to run without third party mediation and based on the revolutionary Blockchain technology are especially relevant. The present paper intends to make a first approximation to the analysis of this type of contracting, from the perspective international private law, in order to guarantee the protection of the rights of the users.El imparable avance de las nuevas tecnologías de la nueva era digital en la que estamos inmersos está permitiendo cada vez una mayor automatización de todos los procesos productivos, cobrando mayor protagonismo el software y los algoritmos informáticos encargados de ejecutar automáticamente las órdenes programadas previamente. En este entorno de automatización generalizada, cobra especial relevancia los Smart Contracts (contratos inteligentes) que se pueden realizar entre las partes y que tienen la capacidad para auto ejecutarse sin mediación de terceros y basados en la revolucionaria tecnología de Blockchain (cadena de bloques).
