Summary: The principal innovation of Council Regulation (EU) 2019/1111 is the abolition of exequatur for all decisions in matters of parental responsibility, while still retaining an even more favorable treatment of certain decisions granting rights of access and certain decisions entailing the return of a child. However, a series of modifications are introduced to make the previous regulation more flexible and to meet the best interest of the child. In addition, some rules on the enforcement of decisions are harmonized. With these solutions the European legislator tries to respond to the deficiencies detected in the application of Regulation 2201/2003.
