It is shown, however, that the conclusion reached by Brazilian Courts in order to limit the interest rates in these contracts to 12% per annum (1% per month) is correct, even if the arguments have not been solidly built. The paper also mentions, without trying to expand it further, special provisions that are reserved for interest rates in the context of financial and banking operations as well as consumer contracts.Este artigo aborda a disciplina da usura no direito civil brasileiro. Sustentamos que a Lei de Usura, no que disciplina a limitação imposta aos juros estipulados em contratos civis e empresariais (não de consumo), foi revogada pela Código Civil de 2002. Demonstramos, porém, que a conclusão a que os Tribunais têm chegado, ao limitar os juros desses contratos a 12% ao ano (1% ao mês) é correta, ainda que obtida por vias argumentativas menos consistentes.
