Summary: In a sector of work in which women represent more than 90% of the people employed, it is undeniable that the regulation must overcome the filter of the principle of equality and non-discrimination based on sex. The study presented aims to address the legislative protection of the family home service, integrating the gender dimension after Royal DecreeLaw 16/2022, of September 6, for the improvement of working conditions and Social Security of home workers. It will analyze to what extent the objectives that the legislator intended to cover are being achieved, as well as the deficiencies and reluctance that still exist that do not even lead to proposing the disappearance of this special system as a possible solution.
