In this sense, the study of the Peruvian reality between 1821 and 1899 is fundamental, especially because the constitutional political model is based on the regulation of economic and commercial conditions in Peruvian society, for which a historical-dogmatic study is presented. which proposes an interdisciplinary analysis with a projection to the presentLa finalidad de esta investigación es analizar la relación que ha existido entre el Derecho Constitucional y el Derecho Comercial en el Perú en el siglo XIX, con el nacimiento de la República. De este modo, la evaluación de la realidad social y jurídica con la declaración de la independencia hasta la actualidad permite observar una “república inconclusa” que no ha logrado generar un sistema normativo que garantice la gobernabilidad, la democracia, la seguridad jurídica a la población.
