Summary: The purpose of this research is to analyze the relationship that has existed between Constitutional Law and Commercial Law in Peru in the nineteenth century, with the birth of the Republic. In this way, the evaluation of the social and legal reality with the declaration of independence to date allows us to observe an "unfinished republic" that has not managed to generate a regulatory system that guarantees governance, democracy, legal security to the population. In this sense, the study of the Peruvian reality between 1821 and 1899 is fundamental, especially because the constitutional political model is based on the regulation of economic and commercial conditions in Peruvian society, for which a historical-dogmatic study is presented. which proposes an interdisciplinary analysis with a projection to the present
