Summary: This article presents an analysis whose purpose is to determine the impact of misleading advertising on the rights of consumers in Colombia; for this, the requirements that configure it are studied with support in concepts and jurisprudence of the Superintendency of Industry and Commerce (hereinafter SIC) identifying the factors of imputation of the conduct; the notion of average consumer and the applicable grounds for exemption. Subsequently, the procedure carried out by the SIC in the exercise of its administrative functions is studied, describing the preventive measures, the criteria to impose sanctions, and the resources that act against these decisions.
