Among the main findings is the identification of the parameters of the expert evidence, where it is established that several countries have laws where they sanction malpractice drastically and independently, not in Ecuador, where the sanction is more common in the criminal environment than in the civil and administrative environment.La prueba pericial que determina si existe o no daños derivados de una mala práctica médica, esta prueba representa el eje fundamental de la actividad probatoria durante los juicios de responsabilidad por actos de salud. En base a lo expuesto se plantea como finalidad de este estudio estatuir los parámetros de la prueba pericial en casos de responsabilidad por actos de salud. La metodología descriptiva.
