Laburpena: The expert test that determines whether or not there is damage derived from medical malpractice, this test represents the fundamental axis of the evidentiary activity during the trials of responsibility for health acts. Based on the foregoing, the purpose of this study is to establish the parameters of the expert evidence in cases of responsibility for health acts. The descriptive methodology. Among the main findings is the identification of the parameters of the expert evidence, where it is established that several countries have laws where they sanction malpractice drastically and independently, not in Ecuador, where the sanction is more common in the criminal environment than in the civil and administrative environment.
