This allowed to show how the implementation of the National Leveling and Admission System based on meritocracy and based on the principle of equal opportunities violates the right of access to higher education, since it is seen from the premise that every student is capable of getting into the university if he/she proposes it, without taking into account the environment and the conditions in which the student develops, thus giving greater opportunities to the so-called "privileged".El presente trabajo de investigación pretende evidenciar como la meritocracia vulnera el derecho al acceso a la educación superior basada en el principio de igualdad de oportunidades. La investigación es de tipo descriptiva con análisis bibliográfico y documental de literatura existente, basados en argumentos teóricos y legales, que evidencian esta problemática.
