Summary: This research work aims to show how meritocracy violates the right to access to higher education based on the principle of equal opportunities. The research is descriptive with bibliographic and documentary analysis of existing literature, based on theoretical and legal arguments, which show this problem. This allowed to show how the implementation of the National Leveling and Admission System based on meritocracy and based on the principle of equal opportunities violates the right of access to higher education, since it is seen from the premise that every student is capable of getting into the university if he/she proposes it, without taking into account the environment and the conditions in which the student develops, thus giving greater opportunities to the so-called "privileged".
