The approach taken by the researchers for the development of the methodology was based on the methodology with quantitative approach, through the inquiry, collection and critical analysis of documents and bibliographic references, based on the methodical, rigorous and deep exploration of various documentary sources consisting of articles, rules and laws among others, describing the findings. In the research, documentary review was used as a technique. It is concluded that the constitutional and ordinary legal interpretation of the weighting of rights is an act in which the prevalence of the norm that most favors the principles and rights established in the Constitution is sought, since the operators of justice must seek an effective way, so that fundamental rights are not affected.En la presente investigación se planteó como objetivo general analizar jurídicamente la interpretación jurídica constitucional y ordinaria: Preeminente en la ponderación de los derechos. El planteamiento realizado por los investigadores para el desarrollo de la metodología fue a partir de la metodología con enfoque cuantitativo, mediante la indagación, recolección y análisis crítico documental y referencial bibliográfico, basándose en la exploración metódica, rigurosa y profunda de diversas fuentes documentales conformadas por artículos, normas y leyes entre otros, describiendo los hallazgos encontrados. En la investigación, se empleó como técnica la revisión documental.
