The general objective of this research was to legally analyze the constitutional and ordinary legal interpretation: Preeminent in the weighting of rights. The approach taken by the researchers for the development of the methodology was based on the methodology with quantitative approach, through the inquiry, collection and critical analysis of documents and bibliographic references, based on the methodical, rigorous and deep exploration of various documentary sources consisting of articles, rules and laws among others, describing the findings. In the research, documentary review was used as a technique. It is concluded that the constitutional and ordinary legal interpretation of the weighting of rights is an act in which the prevalence of the norm that most favors the principles and rights established in the Constitution is sought, since the operators of justice must seek an effective way, so that fundamental rights are not affected. |
