Supported by a documentary-bibliographic study, critically analyzing sources made up of laws, articles, theses. Describing the findings found, allowing to develop the theoretical body in relation to the subject of study. It is concluded that, the application of the right to health and the right to education, the State has tried to generate a balance through the implementation of mechanisms and the use of existing tools in order not to diminish the access to education for girls and boys so as not to slow down their correct development. In order to generate an adaptability to access to health and education.En la presente investigación, se planteó como objetivo general analizar jurídicamente el derecho a la educación primaria y la salud en niños y niñas durante el covid-19. Se desarrolló la metodología cuantitativa la cual produce datos descriptivos, que se originan por la recolección de datos, de fuente documental-bibliográfica. Apoyado en un estudio documental-bibliográfico, analizando críticamente fuentes conformadas por leyes, artículos, tesis. Describiendo los hallazgos encontrados, permitiendo desarrollar el cuerpo teórico en relación al tema de estudio. Se concluye que, la aplicación del derecho a la salud y el derecho a la educación el Estado ha intentado generar un equilibrio mediante la implementación de mecanismos y con la utilización de herramientas ya existentes con la finalidad de no menguar el acceso a la educación por parte de niñas y niños para no frenar su correcto desarrollo.
