Summary: The general objective of this research was to legally analyze the right to primary education and health in children during the covid-19 period. The quantitative methodology was developed, which produces descriptive data, originating from the collection of data from a documentary-bibliographic source. Supported by a documentary-bibliographic study, critically analyzing sources made up of laws, articles, theses. Describing the findings found, allowing to develop the theoretical body in relation to the subject of study. It is concluded that, the application of the right to health and the right to education, the State has tried to generate a balance through the implementation of mechanisms and the use of existing tools in order not to diminish the access to education for girls and boys so as not to slow down their correct development. In order to generate an adaptability to access to health and education.
