It can be pointed out that it is appropriate that a procedure where a third party is in search of the truth or to determine who accompanies the affirmation of the accusation can act ex officio and practice evidence, because this allows in case of doubt to delimit who accompanies the certainty; while, in the case of the administrative procedure it is not appropriate to act ex officio evidence because there is no confrontation of truths, but there is only an accusation.Se tiene por objetivo analizar la prueba de oficio en el procedimiento disciplinario de la función judicial. Se gestionó una investigación de tipo documental descriptiva con diseño bibliográfico.
