Summary: The objective is to analyze the ex officio evidence in the disciplinary procedure of the judicial function. A descriptive documentary research with bibliographic design was carried out. It can be pointed out that it is appropriate that a procedure where a third party is in search of the truth or to determine who accompanies the affirmation of the accusation can act ex officio and practice evidence, because this allows in case of doubt to delimit who accompanies the certainty; while, in the case of the administrative procedure it is not appropriate to act ex officio evidence because there is no confrontation of truths, but there is only an accusation.
