Summary: The general objective of the research was to legally analyze the ex officio evidence called evidence to better resolve based on the principle of impartiality. The research path was followed under the quantitative approach, by means of inquiry, collection and critical analysis through a documentary, bibliographic and statistical typology. A bibliographic design of documentary type, which seeks reflection and critical analysis, and to build related methods of discernment of the phenomenon and thus evaluate or consider new contexts. In addition, a survey was applied to a sample of 166 lawyers out of a total population of 967, enrolled in the Bar Association. It is concluded, the principle of equity is a decisive adjustment of obligation to provide to the judges who have to their recrimination the practice of the jurisdictional office, which consists of the responsibility that they have to be alien or strange to the assets of the parties of the controversy.
