The hypothesis posed is the following: If the factors of the immediate process limit the right of defense, then it injures the fundamental rights of the accused. The analysis of the data collected shows that the factors of the immediate process limit the right of defense, thus violating the norms that defend the rights of the accused.El presente artículo analiza la afectación entre la aplicación del proceso inmediato y el derecho de defensa del inculpado, derecho regulado en la Declaración Universal de 1948 y también en la Convención Americana de los Derechos Humanos de 1969. La metodología utilizada fue de enfoque cuantitativo pues se manipula la recaudación de datos para comprobar hipótesis con la comprobación numérica. La hipótesis que se plantea es la siguiente: Si los factores del proceso inmediato limitan el derecho de defensa, entonces lesiona los derechos fundamentales del inculpado.
