This article analyzes the impact between the application of the immediate process and the right of defense of the accused, a right regulated in the Universal Declaration of 1948 and also in the American Convention on Human Rights of 1969. The methodology used was quantitative in approach, since data collection is manipulated to test hypotheses with numerical verification. The hypothesis posed is the following: If the factors of the immediate process limit the right of defense, then it injures the fundamental rights of the accused. The analysis of the data collected shows that the factors of the immediate process limit the right of defense, thus violating the norms that defend the rights of the accused. |
