At present, most of the case law and doctrine is inclined towards the subsumption of urbanization works in the form of construction contracts provided for in Law 9/2017, of 8 November. However, the position is not unanimous, and there are sufficiently solid and coherent arguments to at least keep this interesting debate, which integrates two of the most terrestrial sui generis branches of administrative lawCuando las juntas de compensación se ven obligadas a externalizar la ejecución de las obras de urbanización al no contar con empresas urbanizadoras, surge la controversia jurídica sobre si debe someterse tal supuesto de hecho a los procedimientos previstos en la normativa de contratación pública, o si, por el contrario, la adjudicación de dichas obras debe esquivar la legislación de contratos del sector público. En la actualidad, la jurisprudencia y doctrina mayoritaria se inclina por la subsunción de las obras de urbanización en la carcasa de los contratos de obras previstos en la Ley 9/2017, de 8 de noviembre.
