Laburpena: When the compensation councils are forced to outsource the execution of the public urban development works as they do not have urbanization companies, the legal controversy arises as to whether such a case should be subject to the procedures provided for in the public procurement regulations, or whether, on the contrary, the awarding of such works should avoid the public sector contract legislation. At present, most of the case law and doctrine is inclined towards the subsumption of urbanization works in the form of construction contracts provided for in Law 9/2017, of 8 November. However, the position is not unanimous, and there are sufficiently solid and coherent arguments to at least keep this interesting debate, which integrates two of the most terrestrial sui generis branches of administrative law
