In order to avoiding the international phenomenon of reproductive tourism, it would be recommendable that the States that allow surrogate motherhood introduce in their legal systems that one of the two principals be a national of that State.En este trabajo se aborda la situación vigente en España de la maternidad subrogada desde una perspectiva jurisprudencial, legal y doctrinal. Esta situación evidencia el desbordamiento del legislador español y la ineficacia de normativa española, ya que esta no impide que se reconozcan efectos legales en España a los contratos de maternidad subrogada llevados a cabo en el extranjero.
