Summary: This paper addresses the current situation in Spain of surrogate motherhood from a jurisprudential, legal and doctrinal perspective. This situation demonstrates the overflow of the Spanish legislator and the ineffectiveness of Spanish regulations, since this does not prevent the recognition of legal effects in Spain for surrogate motherhood contracts carried out abroad. In order to avoiding the international phenomenon of reproductive tourism, it would be recommendable that the States that allow surrogate motherhood introduce in their legal systems that one of the two principals be a national of that State.
