The present text has as its main objective to establish the point of contact between decolonial thought and international law. This is because, as decoloniality emerged as a counterpoint to coloniality inaugurated in modernity, which elevated the European/Global North to the center of the world system and established a hierarchical, oppressive and excluding structure seen until today, it becomes a theoretical basis for questioning the existing oppression in the field of International Law. After all, this branch of Law, a point of colonialist elements since its origin, is now being questioned because not only does it listen to the Third World, but also because it does not respond to its wishes or because it allows it to collaborate with the dynamics of new rules, as points the Third World Approaches of International Law. Therefore, through a research of an applied nature, following the deductive method of approach and the bibliographic review technique, we seek to understand a relationship between them, concluding, in the end, that decoloniality, expressed by third-world approaches, it is of paramount importance to contest the role assigned to the Global South in International Law.

Isso porque, tendo a decolonialidade emergido como contraponto à colonialidade inaugurado na modernidade, o qual elevou o Europeu/Norte Global ao centro do sistema mundial e estabeleceu uma estrutura hierarquizada, opressora e excludente a qual ainda se mantém na atualidade, ele se torna uma base teórica adequada para questionar a opressão existente no campo do Direito Internacional. Afinal, este ramo do Direito, dotado de elementos colonialistas desde a sua origem, passa a ser questionado na atualidade em razão de não apenas não ouvir o Terceiro Mundo, mas também por não responder seus anseios ou por permitir que ele colabore com a formulação de novas regras, como aponta o Movimento Terceiro Mundista de Direito Internacional. Logo, através de uma pesquisa de natureza aplicada, seguindo o método dedutivo de abordagem e a técnica da revisão bibliográfica, busca-se compreender a relação entre eles, concluindo-se, ao cabo, que a decolonialidade, expressada pelas abordagens terceiro-mundistas, é de suma importância para contestar o papel designado ao Sul Global no Direito Internacional.Le présent texte a pour objectif principal d'établir le point de contact entre la pensée décoloniale et le droit international. En effet, à mesure que la décolonialité émergeait comme un contrepoint à la colonialité inaugurée dans la modernité, qui élevait le Nord Européen/Global au centre du système mondial et instaurait une structure hiérarchique, oppressive et excluante vue jusqu'à aujourd'hui, elle devient une base théorique de questionnement l'oppression existante dans le domaine du droit international. Après tout, cette branche du Droit, point d'éléments colonialistes depuis son origine, est aujourd'hui remise en cause parce que non seulement elle écoute le Tiers-Monde, mais aussi parce qu'elle ne répond pas à ses souhaits ou parce qu'elle lui permet de collaborer avec la dynamique des nouvelles règles, comme le souligne les Approches Tiers-Monde du droit international. Par conséquent, à travers une recherche de nature appliquée, suivant la méthode d'approche déductive et la technique de la revue bibliographique, nous cherchons à comprendre une relation entre elles, concluant, au final, que la décolonialité, exprimée par les approches du tiers-monde, est de importance primordiale de contester le rôle attribué aux pays du Sud en droit international.El presente texto tiene como principal objetivo establecer el punto de contacto entre el pensamiento descolonial y el derecho internacional. Esto se debe a que, como la descolonialidad surgió como contrapunto a la colonialidad inaugurada en la modernidad, que elevó al norte europeo / global al centro del sistema mundial y estableció una estructura jerárquica, opresiva y excluyente vista hasta hoy, se convierte en una base teórica para cuestionar la opresión existente en el campo del Derecho Internacional. Al fin y al cabo, esta rama del Derecho, punto de elementos colonialistas desde su origen, ahora está siendo cuestionada porque no solo escucha al Tercer Mundo, sino también porque no responde a sus deseos o porque le permite colaborar con la dinámica de las nuevas reglas, como apuntan los Enfoques del Derecho Internacional del Tercer Mundo.
