For this reason, on 25 May 2022, the EU institutions presented the Proposal for a Directive of the European Parliament and of the Council on the recovery and confiscation of assets, which represents a profound transformation of the institution and in turn constitutes a new opportunity for the national legislator to adapt and reform domestic legislation, overcoming the shortcomings and excesses that occurred with the first transposition.Ocho años después de la aprobación de la Directiva 2014/42/UE sobre el embargo y el decomiso de los instrumentos y del producto del delito en la UE, no se han conseguido los resultados esperados y se han acreditado graves deficiencias que hay que superar.
